Abstract:

In Moldavian specialized literature, the terms “reţinere” (detention) and “infractor” (criminal) are assimilated in the context of its use. In other words, they manifest their meaning depending on the context. From the point of view of the actual legislation of Republic of Moldova, this fact leads to confusion, because the mentioned terms can be taken both in the "stricto sensu" and in the "largo sensu".
